Intellectual Property Act 2014: Changes to Unregistered Design Law

The Intellectual Property Act 2014 brought with it a number of changes to the IP landscape.

One such change is to unregistered design law.  For unregistered designs created since 1 October 2014 pursuant to a commission, the owner of the design will now be the designer (rather than the commissioner, which was previously the case). 

It is still possible to contractually change this position and the new law does not affect designs created pre-1 October 2014.

This will be an important change for designers and businesses that contract with third parties to design for them.
