Did you know that if you place a record of an informal warning on an employee’s personnel file you have arguably converted it into a formal warning? This would place you in breach of the employee’s statutory right to be accompanied which could render you liable to pay compensation to the employee. It will also be a technical breach of the ACAS Code.
