Holiday ‘Pay’ from Hell
The recent European Court of Justice decision in the case of Lock v British Gas Trading Ltd said that statutory holiday pay should include a sum in respect of commission.
This case could have wide reaching consequences for business and their workers as we could see claims going back over many years. This decision has also raised the question as to whether overtime pay should be included in ’normal remuneration’ when holiday pay is calculated.
