Ministry of Justice issues guidance on marketing for Claims Management Companies

The Ministry of Justice has published a Guidance Note to offer advice and assistance to Claims Management Companies in complying with the law applicable to advertising and marketing.

“Claims Management Companies” are companies which handle claims such as PPI compensation. Though it must be noted that the publication, entitled ‘Claims Management Regulation: Marketing and Advertising Guidance Note July 2013’ does not operate to extend existing rules or create new ones, it provides substantive guidance for such businesses in complying with legal requirements. The note is broken down to consider each specific means of marketing in turn, including telemarking, SMS marketing and email marketing amongst others.
