New case on recovering rent in administration cases

On the 24 February 2014 the Court of Appeal overturned the law dealing with the payment of rent in commercial premises, where a tenant had gone into administration ruling that Landlords must be paid for the use of the premises on a ‘pay as you go’ basis. The ruling came in a case involving Game Station Limited and closes the loop hole that allowed companies in administration to trade for three months without paying rent, if the administrators were appointed the day after a quarter day was due.
