New Employment reforms
In the relatively fast-paced world of employment law reforms and updates are extremely regular. One of the latest reforms, entitled The Enterprise and Regulatory Reform Act 2013, comes as a result of Mr Justice Underhill’s review of the employment tribunal procedure.
Following this review and further consultation the new rules are more compact than previously and include a number of measures designed to enable employers and employees to settle disputes early. Among the changes is a provision that means employers will now be able to begin termination discussions with their employees without fear of these discussions becoming part of an unfair dismissal claim in most circumstances. There are also provisions that mean that ‘compromise agreements’ have been renamed to ‘settlement agreements’ in order to create a more positive impression of their use.
