New IP Act: Changes to ownership of designs
We have previously blogged about the upcoming changes to the IP landscape which will come into force later this year with the new Intellectual Property Act 2014.
One of the changes being introduced, which will bring unregistered designs law into line with copyright law, is that (when the provision comes into force), the first owner of the unregistered design created pursuant to a commission will be the designer of the design. Currently, the commissioner of the design created under a commission arrangement is the first owner of the unregistered design.
This is important to note as the parties to a commission arrangement will need to ensure that the contractual arrangements deal with ownership expressly if they do not want the ownership of the design to remain with the designer.
